These terms of use govern your use of the website located at www.app.houselabpro.com (Website), owned and operated by HouseLab Media Pty Ltd (HouseLab), and/or your use of the HouseLab service as a free account holder under our Home Owner or Contractor plans (User Accounts).
You indicate your acceptance of these terms by using any part of the Website or by accessing your User Account. If you do not agree with any part of these Terms of Use, you must stop using the Website and accessing your User Account, if you have one.
1. What is the HouseLab Service?
HouseLab is a service that connects renovators, builders and designers for the residential construction industry through an online collaboration platform and communication hub.
HouseLab has three types of User Accounts:
- 1. Home Owner: for home owners and renovators
- 2. Contractor: for trades people
- 3. Professional: for architects, designers, builders and developers
Home Owner and Contractor User Accounts are provided by HouseLab as a free service (the Free Service), use of which is governed by these Terms of Use. Professional Accounts are a paid service governed by a separate HouseLab Software-as-a-Service Agreement.
As a Home Owner your Account will be linked to, and you will have administrative control over, an online page that is specific to each residential unit that you own or control (whether a house, unit, apartment or other abode) (the physical residence is referred to herein as the Property and the online page is referred to herein as a Property Page).
A Contractor’s Account provides access to a specific section of a Property Page relevant to the services you have provided in relation to that Property.
2. Personal Information
In order to operate and improve the Website and the Free Service, HouseLab may monitor and record certain aspects of your use of the Website or the Free Service. All information collected is regulated by HouseLab’s Privacy Policy, which complies with applicable Australian laws. You authorise HouseLab to collect, store and use such information and waive any right of action in connection with the collection, storage and use of such information by HouseLab or an authorised associate of HouseLab.
3. Personal Use Only
The Free Service is made available to Home Owners and Contractors for your personal use only. Home Owners and Contractors must not display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer or upload for any commercial purposes, any portion of the Website or the Free Service.
You agree that you won’t, and won’t permit anyone else to, use any data mining, robots, scraping or similar data gathering or collection tools or methods in connection with the Free Service.
4. Property Data
Any information existing on, or submitted to, your Property Page, whether by yourself or a third party (Property Data), is owned by the owner of the Property until the date the Property Page is transferred to a new owner (the Handover Date). On the Handover Date, Home Owners acknowledge that ownership of Property Data will be transferred to the new owner, and the original Home Owner agrees to take all necessary action, via the Property Page or otherwise, to hand control of the Property Page to the new owner.
HouseLab reserves the right to restrict your access to a Property Page if you no longer own the Property related to that Property Page.
5. Use of Website
You must use the Website in a responsible manner. You must not attempt to breach or circumvent Website security (Hacking) or use the Website in connection with any Hacking activities. In addition, you must not use the Website to:
- Breach any law, third party rights or any applicable codes or regulations;
- Send unsolicited or unwelcome messages;
- Mislead or deceive;
- Post or transmit information that infringes the rights of a third party, including the right of privacy or publicity;
- Cause the spread of a virus or another harmful object;
- Post or transmit junk mail, "spam" or "chain letters";
- Collect or store personal data about others without permission;
- Promote in any way illegal or unwelcome activities; or
- Undertake promotions or commercial activity.
6. Service Changes
We are always looking for ways to improve the Website and the Free Service which means we may add or remove functionality or features, or we may suspend or stop the Free Service altogether.
7. Intellectual Property Rights
You acknowledge and agree that the Free Service and Website may contain content, features, information or technology that are protected by intellectual property laws including but not limited to: copyright, patent, trade marks and database rights. All such intellectual property rights are owned (or licensed) to HouseLab and nothing in these Terms of Use transfers any of those rights to site visitors or account holders.
- No documents or related graphics on this Website are modified in any way;
- No graphics on this Website are used separately from accompanying text;
- No third party or end user licenses are breached; and
- Houselab’s copyright and trade mark notices appear unobscured in all copies.
8. Third Party Material, Linked Websites and Email Communications
You acknowledge and agree that HouseLab is not responsible or liable in any way for any content or material of other account holders to which you may have access through the Free Service (such as Professionals or other Contractors) or other third parties (such as advertisers) which site visitors and account holders may have access to through the Website and/or the Free Service.
For your convenience, HouseLab may provide links or access to other websites and locations on the Internet, that are not under the control of HouseLab (Linked Websites), through the Website or the Free Service. Inclusion of a link does not imply endorsement by HouseLab and HouseLab has no control over the content of such Linked Websites. You acknowledge and agree that HouseLab is not responsible or liable in any way for such Linked Websites including any damage or loss caused or suffered in any way in connection with your use or reliance on such Linked Websites. Your use of such Linked Websites is at your own risk.
You also agree to receive electronic mail from HouseLab that may contain information about Houselab, its partners and their products or services. If you do not wish to receive information about our partner offers, you will be offered the opportunity to unsubscribe from such offers. If you are an active user of the HouseLab platform, you will continue to receive electronic mail that is relevant to your ongoing use of the HouseLab service.
9. Limitation of Liability & Disclaimer
While HouseLab aims to keep the Website and the Free Service available 24 hours a day and free from errors, it is possible that part or all of the Website or the Free Service may be temporarily inaccessible or may not function properly, or the Website could contain errors, inaccuracies and omissions.
HouseLab provides the Website and the Free Service "as is" and makes no warranties of any kind, implied or express, except as required by law. You agree that all warranties, express or implied, are excluded. To the maximum extent permitted by law, HouseLab excludes all liability for any loss or damage whatsoever suffered in connection with the use of the Website or the Free Service, or in connection with the inability to use this Website or the Free Service.
HouseLab makes no representations concerning any Data, Contractors, product suppliers or other information contained in or accessed through the Services. HouseLab will not be responsible or liable for the accuracy, copyright compliance, or legality of material, Data or other information contained in or accessed through the Services.
For the avoidance of doubt, the inclusion of a Contractor or product supplier on the HouseLab Website does not indicate any representation by HouseLab as to the quality, timeliness, cost or any other aspect of that Contractor’s or product supplier’s goods or services.
10. Latest Versions
We may vary these Terms of Use in the future. The most recent version can always be accessed at www.app.houselabpro.com. Changes will not apply retrospectively but by continuing to use the Free Service and accessing the Website you will be taken to have agreed to any updated Terms of Use.
11. General
If you fail to comply with these Terms of Use, and we don’t take action right away, that doesn’t mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular part of these Terms of Use is not enforceable, this will not affect any other part.
12. Governing law and courts
The laws of the State of Victoria, Australia govern these Terms of Use. You agree to submit to the exclusive jurisdiction of the courts of the State of Victoria, Australia in relation to any disputes or claims.
13. Termination of Free Service
You may stop using the Free Service at any time by simply following the termination instructions provided for in the Account. You may download one copy of the Property Page related to your Property prior to deletion.
